ScanMailX™ is a Danish company which is based on numerous years of experience in spam and virus filtering for businesses. Our filtering systems are based on several Open Source Systems, which is why we can deliver our services at such competitive prices.

ScanMailX's goal is to not let the soaring volume of spam be a financial burden on individuals and businesses. This goal we will achieve by developing and refining our spam filter and antivirus offers to be the simplest on the market that require the least possible of the user while keeping prices at the lowest possible level. Our motto is "the less maintenance the better".

ScanMailX has a goal to be the cheapest and best on the market - and we cannot be that if we also will bear the risk and cover of possible economic losses caused by events outside our control. Therefore neither can nor will ScanMailX take financial responsibility for any loss of data associated with the use of ScanMailX´s solutions.

TERMS AND CONDITIONS

Active from July 1st, 2009

1. General Terms

ScanMailX’s different subscriptions models and their respective prices and services can be seen at www.scanmailx.com. In the following the Customer chosen subscription is referred to as “Subscription”. ScanMailX reserves the right to change prices as per section 2 below.

The Subscription will generally be created immediately after acceptance of these terms and received payment for the subscription. The Customer will receive a confirmation of the payment and creation of the Subscription via email at the Customer registered email address.

ScanMailX ApS (CVR: 28137389) is located at Kløvervang 4, DK-2970 Hørsholm, Denmark.

2. Subscription period, payment and termination of Subscription

The Customer must pay ahead of the Subscription period which is one (1) year at a time. Renewals must be done before the Subscription expires and must also be paid ahead of the extended period.

Payments are, if nothing else has been agreed, conducted online by use of VISA/Dankort, Eurocard, Mastercard, VISA, VISA Electron or American Express.

The Customer can within the first 30 days after subscription terminate the Subscription with complete refund. The termination must be done via www.scanmailx.com or via letter to ScanMailX’s address. The Termination must specify the name of the domain and a copy of the invoice. It is not possible to terminate and get a refund after 30 days of active subscription.

ScanMailX reserves the right to terminate a Customer Subscription with 30 days of written notice and refund the Customer in relation to the remaining Subscription period. The termination letter will be sent to the email address registered by the customer at www.scanmailx.com.

ScanMailX cannot in any way or another be held responsible for errors in relation to mistyping of domain names when registering the Subscription.

3. Expiration of Subscription

When using free services such as ScanMailX Trial Subscriptions the Subscription expires after 21 days. Paid services will not expire as long as the Customer is paying the Subscription.

ScanMailX will as a minimum 7 days before the expiration send a notification email to the email address registered at www.scanmailx.com. If the Customer has not renewed its Subscription or paid for the services when running a Trial Subscription, ScanMailX will with no further warning delete the Customer’s account information and Subscription.

4. Change of Subscription

The Customer can at any given time upgrade the Subscription to a higher level. This change can be done online and will be activated as soon as payment has been received. It is not possible to change the Subscription to a lower payment class within a subscription period.

5. Restrictions on Use of Subscription

It is not allowed to use ScanMailX to transmit or receive illegal material of any kind and the Customer must under no circumstances use ScanMailX services in a way which is illegal according to Danish or international law.

ScanMailX UNLIMITED offers in reality an unlimited amount of email addresses associated with the Subscription but ScanMailX has set an upper limit for this Subscription of 200 active email addresses. If the Customer has more than 200 email addresses associated with the ScanMailX UNLIMITED domain, ScanMailX reserves the right to terminate the Subscription if a mutually agreed financial agreement cannot be made.

In case of suspicion of misuse, ScanMailX reserves the right to investigate whether the Customer has misused the Subscription and the Customer is obligated to participate in the investigation.

6. Acceptable Use

We have a strict policy against spamming. We forbid the use of the service to send unsolicited mass emails or unsolicited emails of any kind. We reserve the right to terminate your account "for cause" if we deem you to be in violation of our anti-spamming policies. We also reserve the right to suspend your account pending review upon receipt of any complaint or other evidence that you may be engaging in any spamming activity.

We consider spamming to be any activity whereby you directly or indirectly transmit email messages to any email address that has not solicited such email and does not consent to such transmission.

You must also NOT use the service to send emails that contain content related to the following industries. Such emails, even if 'opt-in', generate a high proportion of complaints and could jeopardize our service for all of our users.

  • Pornographic or adult content
  • Adult novelty items
  • Dating or escort services
  • Multi-level marketing
  • Affiliate marketing
  • Pharmaceutical products
  • Get-rich-quick or work-at-home schemes
  • Online trading, forex trading, or stock market related content
  • Gambling services, products or gambling education
  • Credit repair, get-out-of-debt content
  • Mortgages and/or Loans
  • Real estate prospecting or listing
  • Nutritional Supplements, Herbal Supplements or Vitamin Supplements
  • List brokers or List rental services
  • Marketing or sending commercial email without proper permission

You must also NOT use the service to a) knowingly send emails containing viruses, worms, or any other harmful code or software, b) send defamatory, harmful, abusive, vulgar or obscene content or material, c) send emails that are not in compliance with all applicable laws, or that do infringe upon the rights of any other party, including but not limited to copyrights, trademarks, privacy rights, moral rights, trade secrets, patents and any other rights d) harass or send threatening content.

You must also NOT use the service in a manner that substantially reduces performance for other subscribers, send "mailbombs" or other harmful devices, or engage in activity designed to gain unauthorized access to any of our computers or information.

In the event that we deem you to be in violation of any of these policies, we shall immediately suspend your account and take further action as deemed necessary, including pursing legal action.

7. Reliability of Services

ScanMailX reserves the right to, without warning, limit or reduce access to the Subscription or the services within the Subscription if deemed necessary by ScanMailX for security or general service stability reasons.

8. Responsibility

The Customers use of ScanMailX’s services is in all respects the responsibility and risk of the Customer. ScanMailX takes no responsibility for the content and legal aspect of the information the Customer sends and receives. ScanMailX does not take responsibility for third party surveillance or access to Customer information.

ScanMailX takes no responsibility for damages, material or immaterial losses which the Customers might suffer in relation to the use of the Subscription or other ScanMailX services.

9. Third-Party Rights

The Customer is to make sure that Customer data does not infringe the rights of third parties. If there is legal action against the customer or ScanMailX, alleging that ScanMailX's services violate the rights of third parties, ScanMailX is entitled to, of their choice, to (i) change its services so that violations cease, or (ii) terminate this agreement in whole or in part without further responsibility for ScanMailX. In both cases, ScanMailX is entitled to take over the case and the case costs. ScanMailX is authorized to carry out the case or terminate it settlement wise.

10. Mailing Lists

Communication from ScanMailX towards the Customer is to a large extent automated and will usually be done via email. It is therefore a prerequisite to be a customer, that the Customer accepts to receive emails from ScanMailX. By accepting these Terms and Conditions, the Customer therefore accepts to be subscribed to ScanMailX’s mailing lists and from time to time receive information and newsletters. The Customer has the right to opt out from marketing-related material through www.scanmailx.com or from “unsubscribe” options in the newsletters.

11. Contact and Support

12. Transfer of Rights

ScanMailX reserves the right to partly or completely transfer the Subscription and ScanMailX rights and responsibilities to a third party.

13. Change of Conditions

ScanMailX has the right to change the Terms and Conditions with 30 days notices.

14. Applicable Law and Jurisdiction 

The Terms and Conditions including customer Subscription is subject to Danish law and any disputes and disagreements between the Customer and ScanMailX will be determined by the Maritime and Commercial Court in Copenhagen.
